EAEU Technical Regulations "On Restricting the Use of Hazardous Substances in Electrical and Electronic Products" (TR EAEU 037/2016)

I. Scope

  1. Real technical regulations developed in accordance with the Treaty on the Eurasian Economic Union of 29.05. 2014 in order to ensure the protection of human life and health, the environment, as well as to prevent actions that mislead consumers (users) of electrical and radio electronics products regarding the content of hazardous substances in them.
    This technical regulation establishes mandatory requirements for application and implementation in the territory of the Eurasian Economic Union (hereinafter - the Union) to restrict the use of hazardous substances in electrical and electronic products put into circulation on the territory of the Union to ensure their free movement.
    If other technical regulations of the Union (Customs Union) are adopted in relation to electrical and radio electronics products, establishing requirements for these products, then such electrical and radio electronics products must comply with the requirements of all technical regulations of the Union (Customs Union), which apply to them.
  2. The effect of this technical regulation applies to electrical and radio electronics products put into circulation on the territory of the Union according to the list in accordance with Appendix No. 1.
  3. The present technical regulation does not apply to:
    • a) electrical and radio electronics products intended for use at a rated voltage of more than 1000 V AC and 1500 V DC, unless otherwise provided by Appendix No. 1 to this technical regulation;
    • b) electrical and radio electronics products intended exclusively for use as components of electrical equipment not included in the list provided for by Appendix No. 1 to this technical regulation;
    • c) electric toys;
    • d) photovoltaic panels (solar batteries), which are part of electrical and radio electronics products;
    • e) electrical and electronic products intended for use as part of ground and orbital space objects;
    • f) electrical equipment designed exclusively for use in air, water, land and underground transport;
    • g) electric batteries and accumulators, including those put into circulation on the territory of the Union as part of electrical and radio electronics products;
    • h) used (used) electrical and radioelectronic products;
    • i) measuring instruments;
    • j) medical devices.

II. Basic concepts

  1. For the purposes of applying this technical regulation, concepts are used that mean the following:
    • “Toy” - a product or material intended for play by a child (children) under the age of 14;
    • “Electric toy” - a toy in which at least one function is carried out due to electrical energy;
    • "Electrical and radioelectronic products" - products, the functioning of which is due to the intended use, the presence, use, generation, transformation, transmission and distribution of electric currents and (or) electromagnetic fields, which are intended for direct use or are built into machines, mechanisms, apparatus, devices and other equipment;
    • “Importer” - a resident of a member state of the Union who has concluded a foreign trade agreement with a non-resident of a member state of the Union for the transfer of electrical and radio electronics products, sells these products and is responsible for their compliance with the requirements of this technical regulation;
    • "Homogeneous (homogeneous) material" - a material with a constant composition in its entire volume, consisting of one substance or a combination of substances and (or) materials that cannot be separated mechanically (by disassembling, cutting, crushing, grinding or other mechanical action ).

III. Rules for the circulation of electrical and radio electronics products on the Union market

  1. An electrical and radio electronics product is released into circulation on the territory of the Union if it complies with this technical regulation, as well as other technical regulations of the Union (Customs Union), which apply to it, and provided that it has passed the confirmation of conformity in accordance with Section VII of this technical regulation, as well as in accordance with other technical regulations of the Union (Customs Union), which apply to it.
  2. An electrical and radio electronics product, the compliance of which with the requirements of this technical regulation, as well as the requirements of other technical regulations of the Union (Customs Union) has not been confirmed, should not be marked with a single mark of product circulation on the Union market.

IV. Requirements for the Restriction of the Use of Hazardous Substances

  1. An electrical and radio electronics product must be designed and manufactured in such a way that it does not contain:
    • a) hazardous substances according to the list in accordance with Appendix No. 2;
    • b) homogeneous (homogeneous) materials containing hazardous substances in a concentration exceeding the permissible level specified in the list provided for in Appendix No. 2 to this technical regulation.
  2. With regard to electrical and radio electronics products, special requirements have been established to restrict the use of hazardous substances in accordance with Appendix No. 3.

V. Requirements for marking and operational documents

  1. The name and (or) designation of the electrical and radio electronics product (type, brand, model (if any)), its main parameters and characteristics, the name and (or) the manufacturer's trademark, the name of the state in which the electrical and radio electronics product is manufactured must be applied to this product and specified in the operating documents attached to it.
    In this case, the name and (or) designation of the electrical and radio electronics product (type, brand, model (if any)), the name and (or) trademark of the manufacturer must also be applied to the packaging.
  2. If the information provided for in paragraph 9 of this technical regulation cannot be applied to the electrical and radio electronics product, then they can only be indicated in the operating documents attached to this product. In this case, the name and (or) designation of the electrical and radio electronics product (type, brand, model (if any)), the name and (or) trademark of the manufacturer must be applied to the packaging.
  3. Marking electrical and radio electronics products must be legible, easy to read and must be applied to the electrical and radio electronics product in a place accessible for inspection without disassembly using a tool.
  4. Operational documents for an electrical and radio electronics product must contain:
    • a) information specified in clause 9 of this technical regulation;
    • b) information on the purpose of the product;
    • c) characteristics and parameters of the product;
    • d) rules and conditions of operation (use), installation, storage, transportation (transportation), sale and disposal of the product (if necessary, relevant requirements);
    • e) information on the measures to be taken when a product malfunction is detected;
    • f) name and location of the manufacturer (manufacturer's authorized person), importer, their contact details;
    • g) information about the month and year of manufacture of the product and (or) about the place where such information is applied or the method of determining the year of manufacture.
  5. Marking and drawing up of operational documents are carried out in Russian and, if there are relevant requirements in the legislation of the Member States of the Union (hereinafter referred to as the Member States), in the official language (official languages) of the Member State in whose territory the products are sold. Units of measurement, alphabetic trademarks, proper names, names of settlements and other names and details in the marking and operating documents may be given in other languages.
    Operational documents are drawn up on paper. They may be accompanied by a set of operational documents on electronic media. Operational documents included in the set of non-household electrical and radio electronics products can be issued only on electronic media.

Vi. Ensuring compliance of electrical and radio electronics products with the requirements of technical regulations

  1. The compliance of electrical and radio electronics products with this technical regulation is ensured by the fulfillment of its requirements to restrict the use of hazardous substances.
  2. Research (test) and measurement methods of electrical and radio electronics products are established by the standards included in the list of standards containing rules and methods of research (tests) and measurements, including sampling rules necessary for the application and fulfillment of the requirements of this technical regulation and the implementation of conformity assessment products.

Vii. Conformity assessment of electrical and radio electronics products

  1. Conformity assessment electrical and radio electronics products are produced in the form of conformity confirmation.
  2. When confirming the conformity of electrical and radio electronics products, applicants can be a legal entity or an individual registered in the territory of a Member State in accordance with its legislation as an individual entrepreneur, who are manufacturers or importers (sellers) or persons authorized by the manufacturer.
  3. Electrical and electronic products are subject to confirmation of conformity in the form of a declaration of conformity according to one of the following schemes:
    • a) for mass-produced products - schemes 1d, 3d and 6d;
    • b) for a batch of products - schemes 2e and 4e.
  4. When declaring the conformity of electrical and radio electronics products, the applicant may be:
    • a) for schemes 1d, 3d and 6d - the manufacturer (the person authorized by the manufacturer);
    • b) for schemes 2d and 4d - the manufacturer (the person authorized by the manufacturer) or the importer (seller).
  5. The choice of the scheme for declaring the conformity of electrical and radio electronics products is carried out by the applicant.
  6. Declaration of conformity of electrical and radio electronics products according to schemes 1d and 2d is carried out by the applicant on the basis of his own evidence. Tests of samples of electrical and electronic products at the choice of the applicant are carried out in the testing laboratory of the applicant, or in an accredited testing laboratory (center) included in the Unified Register of Certification Bodies and Testing Laboratories (Centers) of the Customs Union (hereinafter - the Unified Register), or in another testing laboratories.
    Declaration of conformity of electrical and radio electronics products according to schemes 3d, 4d and 6d is carried out by the applicant on the basis of his own evidence and evidence obtained with the participation of an accredited testing laboratory (center) included in the Unified Register.
  7. When declaring the conformity of electrical and radio electronics products, the applicant:
    • a) generates and analyzes documents confirming the compliance of products with the requirements of this technical regulation, including:
      • specifications (if available);
      • operational documents;
      • protocol (protocols) of testing samples of products and (or) components, materials, components of products for compliance with the requirements of this technical regulation and (or) other documents at the choice of the applicant, which served as the basis for confirming the compliance of products with the requirements of this technical regulation (if any) (diagrams 1e, 2d, 3d, 4e and 6e);
      • Delivery contract (contract) and shipping documentation (if any) (for a batch of products, a single product) (schemes 2d and 4d);
      • certificate for the quality management system (copy of the certificate) (scheme 6d);
    • b) carries out the identification of products in order to refer them to the scope of this technical regulation;
    • c) ensures the conduct of production control and takes all necessary measures to ensure that the production process of products ensures their compliance with the requirements of this technical regulation;
    • d) takes all the necessary measures to ensure the stability of the functioning of the quality management system (Scheme 6e);
    • e) accepts a declaration of conformity, which is drawn up according to a unified form and rules approved by the Decision of the EAEC Board dated 25.12.2012 No. 293;
    • f) applies a single sign of product circulation on the Union market after completion of the conformity confirmation procedure;
    • g) after the completion of the conformity confirmation procedure, forms a set of documents, which includes the documents provided for in subparagraph "a" of this paragraph, and a declaration of conformity.
  8. Declaration of Conformity is subject to registration in the manner prescribed by the Decision of the EAEC Board dated 09.04.2013 No. 76.
  9. The validity period of the declaration of conformity for mass-produced electrical and radio electronics products is no more than 5 years. For a batch of electrical and radio electronics products, the validity period of the declaration of conformity is not established.
  10. At the choice of the applicant, confirmation of conformity of electrical and radio electronics products in the form of a declaration of conformity may be replaced by confirmation of conformity in the form of certification according to one of the following schemes:
    • a) for mass-produced products - schemes 1c, 2c and 6c;
    • b) for a batch of products - scheme 3c.
  11. When certifying electrical and radio electronics products, the applicant may be:
    • a) for schemes 1c, 2c and 6c - the manufacturer (a person authorized by the manufacturer);
    • b) for scheme 3c - the manufacturer (manufacturer's authorized person) or importer (seller).
  12. The choice of a certification scheme for electrical and radio electronics products is carried out by the applicant.
  13. When certifying electrical and radio electronics products, the applicant:
    • a) takes all necessary measures to ensure that the production process of products is stable and ensures their compliance with the requirements of this technical regulation;
    • b) generates the following technical documentation:
      • specifications (if available);
      • operational documents;
      • supply agreement (contract) and shipping documentation (if any) (for a batch of products) (Scheme 3c);
      • certificate for the quality management system (copy of the certificate) (scheme 2c);
      • other documents at the choice of the applicant, which served as the basis for confirming the compliance of products with the requirements of this technical regulation (if any);
    • c) submits to the certification body included in the Unified Register, an application for certification of products (with the attachment of technical documentation). The application shall contain information about the document, for compliance with the requirements of which the quality management system is certified (Scheme 2c), as well as about the identifying characteristics of the batch of products and the product units included in it (Scheme 3c);
    • d) applies a single sign of product circulation on the Union market after completion of the conformity confirmation procedure;
    • e) in the event of changes in the design of products or their production technology, which may affect the compliance of such products with the requirements of this technical regulation, notify the certification body in advance (Scheme 1c);
    • f) after the completion of the conformity confirmation procedure, forms a set of documents, which includes the documents provided for in subparagraph "b" of this paragraph, the test report (s), the results of the analysis of the state of production (scheme 1c) and Certificate of Conformity.
  14. When certifying electrical and radio electronics products, the certification body included in the Unified Register:
    • a) analyzes the technical documentation submitted by the applicant and informs the applicant of his decision (indicating the conditions for certification);
    • b) carries out the identification of product samples and their selection from the applicant for testing;
    • c) ensures the testing of product samples (batch of products (samples from a batch) (scheme 3c)) in an accredited testing laboratory (center) included in the Unified Register;
    • d) conducts analysis the state of the applicant's production, the results of which are documented in an act (scheme 1c);
    • e) in case of positive test results and analysis of the state of production, draw up a certificate of conformity in a unified form approved by the Decision of the EAEC Board dated December 25.12.2012, 293 No. XNUMX, and issue it to the applicant;
    • f) enter information about the certificate of conformity in the unified register of issued certificates of conformity and registered declarations of conformity;
    • g) conducts inspection control in relation to certified products during the entire validity period of the certificate of conformity by testing product samples in an accredited testing laboratory (center) included in the Unified Register, and (or) analyzing the state of production (Scheme 1c);
    • h) conducts inspection control in relation to certified products during the entire period of validity of the certificate of conformity by testing product samples in an accredited testing laboratory (center) included in the Unified Register, and analyzing the results of inspection control of the quality management system certification body in relation to the certified management system quality (scheme 2c);
    • i) in case of positive results of inspection control, confirms the validity of the certificate of conformity and makes an appropriate entry in the inspection control act, in case of negative results of inspection control, makes a decision to suspend or cancel the validity of the certificate of conformity and informs the applicant about the decision taken (schemes 1c and 2c).
  15. In the event of conformity confirmation (declaration of conformity or certification) according to schemes providing for the certification of the quality management system, the certification of such a system is carried out by the certification body of the quality management system, registered in the territory of the Member State in accordance with the legislation of this state and accredited in the national system. on accreditation of the Member State.
  16. The validity period of the certificate of conformity for mass-produced electrical and radio electronics products is no more than 5 years. For a batch of electrical and radio electronics products, the validity period of the certificate of conformity is not established.
  17. A set of documents formed after confirmation of the conformity of electrical and radio electronics products is stored:
    • a) for mass-produced products - the applicant has at least 10 years from the date of termination of the declaration of conformity or the certificate of conformity;
    • b) for a batch of products - the applicant has at least 10 years from the date of the end of the sale of the batch of products;
    • c) for a product - from the manufacturer (a person authorized by the manufacturer) for at least 10 years from the date of discontinuation of production (discontinuation of production) of this product.

VIII. Labeling with a single mark of product circulation on the Union market

  1. An electrical and radio electronics product that meets the requirements of this technical regulation and has passed the conformity confirmation procedure in accordance with Section VII of this technical regulation must be marked with a single product circulation mark on the Union market.
  2. Marking with a single sign of product circulation on the Union market is carried out before the release of an electrical and radio electronics product into circulation on the Union market.
  3. A single mark of product circulation on the Union market is applied to each electrical and radio electronics product in any way that provides a clear and clear image throughout the entire service life of the product, and is also given in the operating documents attached to it.
    If it is impossible to apply a single mark of product circulation on the Union market on an electrical and radio electronics product, it is allowed to apply it only on the packaging of the product and in the operating documents attached to it.
  4. An electrical and radio electronics product is marked with a single product circulation mark on the Union market if it meets the requirements of all technical regulations of the Union (Customs Union), which apply to it.

 

The list of electrical and radio electronics products subject to the EAEU technical regulations "On restricting the use of hazardous substances in electrical and radio electronics" (TR EAEU 037/2016)

  1. Electrical and household appliances:
    • a) for the preparation and storage of food and the mechanization of kitchen work, as well as other kitchen equipment;
    • b) for processing (washing, ironing, drying, cleaning) linen, clothes and shoes;
    • c) for cleaning and cleaning the premises;
    • d) to maintain and regulate the indoor climate;
    • e) sanitary and hygienic;
    • f) for hair, nail and skin care;
    • g) for heating the body;
    • h) vibratory massage;
    • i) play, sports and exercise equipment;
    • j) audio and video equipment, television and radio broadcasting receivers;
    • k) sewing and knitting;
    • m) power supplies, chargers, voltage stabilizers;
    • m) for gardening;
    • o) for aquariums and garden ponds;
    • o) electric pumps;
    • p) electric and electronic clocks;
    • c) calculators;
    • r) wiring products;
    • y) extension cords.
  2. Electronic computers and devices connected to them, including their combinations:
    • a) servers, system units of personal computers;
    • b) laptops;
    • c) tablet, pocket, handheld and other small computers;
    • d) keyboards, manipulators, trackers and other control and input devices (computer mice, joysticks, helmets, glasses);
    • e) removable storage devices;
    • f) monitors;
    • g) printers;
    • h) scanners;
    • i) acoustic systems and headphones;
    • j) multimedia projectors;
    • k) readers of biometric information;
    • m) webcams;
    • m) modems;
    • o) uninterruptible power supplies.
  3. Telecommunication facilities (terminal telecommunication devices):
    • a) landline and mobile phones;
    • b) pay phones;
    • c) telefax;
    • d) telexes;
    • e) portable and portable radio stations;
    • f) RFID tags.
  4. Copiers and other electrical office (office) equipment.
  5. Electrified tools (hand-held and portable electric machines).
  6. Light sources and lighting equipment, including equipment built into furniture.
  7. Electromusical instruments.
  8. Gaming and trading machines.
  9. Cash registers, ticket printing machines, ID card readers, ATMs, information kiosks.
  10. Cables, wires and cords intended for use at a rated voltage not exceeding 500 V AC and (or) DC, with the exception of fiber-optic cables.
  11. Automatic switches and residual current devices.
  12. Fire, security and fire-security detectors.
