On the transitional provisions of the EAEU technical regulations "On safety of equipment for children's playgrounds" (TRN EAEU 042 / 2017)

In accordance with clause 2 of Article 52 of the Treaty on the Eurasian Economic Union of May 29 of 2014, clause 3 of the Statute of the Eurasian Economic Commission (Annex No. 1 to the Treaty of the Eurasian Economic Union of 29 of May 2014 of the Year) and clause 11 of Annex No. 2 of the Declaration by XT of NUMX of 23 of May 2014 of the Year) Of the Eurasian Economic Commission, approved by the Decision of the Supreme Eurasian Economic Council of December 98 38 № 20, taking into account the paragraph of the fifth paragraph 2012 of the Order of development, adoption, amendment and cancellation of technical regulations of the Eurasian Economic Union, approved by the Decision of the Council of the Eurasian Economic Commission of 48 June XNUMX, № XNUMX, Board of the Eurasian Economic Commission

  1. Established that:

a) documents on the assessment of the conformity of products to the mandatory requirements established by acts included in the law of the Eurasian Economic Union (hereinafter - the Union), or the legislation of the Member State of the Union (hereinafter - the Member State), issued or adopted in relation to products that are subject to technical regulation of the technical regulation of the Eurasian Economic Union "On the safety of equipment for children's playgrounds" (TP EAEU 042 / 2017) (hereinafter respectively - products, technical regulations), until the day of entry into force of the technical regulation, are valid until the expiration of their validity, but no later than 01.06.2020 g.

From the day the technical regulation comes into force, the issuance or acceptance of documents on the conformity assessment of products to mandatory requirements previously established by acts that are part of Union law or the legislation of a Member State is not allowed;

b) until 01.06.2020, production and release into circulation in the territories of the Member States of products that were not subject to the date of entry into force of the technical regulation of the mandatory assessment of compliance with mandatory requirements established by acts belonging to the Union law, or the legislation of a Member State, without documents on mandatory product conformity assessment and without marking with a national conformity mark (market reference mark);

c) until 01.06.2020, production and release into circulation in the territories of the Member States are allowed in accordance with the mandatory requirements previously established by acts of the Union law or the legislation of the Member State, if there are documents on product conformity assessment to the specified mandatory requirements, issued or adopted before the date of entry into force of the technical regulation.

Products are marked with a national conformity mark (market reference mark) in accordance with the laws of a Member State.

Marking such products are not allowed to use a single circulation mark on the Union market;

d) the circulation of products specified in sub-clauses "b" and "c" of this clause is allowed during the designated service life of such products, as established by the operational documents. Operation (use) for the purpose of this product after the appointed service life is not allowed.

  1. V.N. Koreshkov, Member of the Board (Minister) for Technical Regulation of the Eurasian Economic Commission together with the member states, prepare for consideration at a meeting of the Board of the Eurasian Economic Commission before the date of entry into force of the technical regulation:

a) draft program for the development (amendment, revision) of intergovernmental standards, as a result of which voluntary compliance with the requirements of technical regulations, as well as intergovernmental standards containing rules and methods of research (testing) and measurements, including sampling rules necessary for the application and execution of the requirements of technical regulations and the implementation of conformity assessment of objects of technical regulation;

b) draft list of products in respect of which the submission of a customs declaration is accompanied by the submission of documents on conformity assessment to the requirements of technical regulations.

This Decision comes into force on the date of entry into force of the Decision of the Council of the Eurasian Economic Commission on the adoption of the technical regulations of the Eurasian Economic Union "On safety of equipment for children's playgrounds" (EEU TR 042 / 2017), but not earlier than 30 calendar days from the date official publication of this Decision.
