Phytosanitary requirements for soybeans, corn, aspic, and rapeseed imported from the Russian Federation

Allowed to import soybeans, corn, wild rice and rapeseed intended for processing and not intended for cultivation.

The areas of production from which export of soybeans, corn and sea rice in China are allowed is limited to Khabarovsk Territory, Primorsky Territory, Trans-Baikal Territory, Amur Oblast and Jewish Autonomous Oblast. The territory of rapeseed production for export to China is limited to the lands of Siberia and the Far East.

Requirements prior to shipping and transportation

The Russian side should:

• Conduct monitoring of pests of quarantine significance for the PRC in places of production of soybeans, corn, jellied rice and rapeseed on exportguided by the relevant standards IPPC, as well as keep a record of monitoring.
• Implement comprehensive preventive measures, reduce the degree of occurrence of harmful organisms of quarantine value for the PRC, and also monitor the production of soybeans, corn, aspic, and rapeseed.
• In accordance with the requirements of the Chinese side, provide the Chinese side with information on the above monitoring results and preventive measures.
• Register exporting enterprises and storage facilities for soybeans, corn, aspic rice and rapeseed, ensure compliance with appropriate preventive measures and cleaning, and also provide the Chinese side with a list of registered exporters and storage facilities before exporting registered enterprises to the PRC. The list of registered companies is updated in real time on the website of the Department of Animals and Plants of the General Directorate. Chinese enterprises engaged in the cultivation and storage of grain crops in Russia must submit a registration application to the competent Russian authorities in the field of phytosanitary and meet the above requirements for inspection and quarantine supervision. Enterprises that have not yet been officially registered fall under interim measures, provided that the Inner Mongolia AR and Heilongjiang Provinces and Jilin Provinces comply with the above-mentioned relevant regulatory acts of the General Directorate for Inspection and Quarantine of the Republic of Azerbaijan, they can import.
• Carry out quarantine supervision during the processing, storage and transportation of soybeans, corn, rice and rapeseed, take measures to reduce the risk, prevent the penetration of harmful organisms of quarantine significance for the PRC contained in transported grain crops. The content of live insects, specially added grain impurities or other foreign impurities is prohibited. Soybeans, maize, rice and rapeseed imported into the PRC must undergo appropriate screening and cleaning in order to effectively remove soil, plant debris and weed seeds. During processing, storage and transportation, the above products should not be stored together with products originating from regions not listed above. Soybeans, corn, rice and rapeseed imported into the PRC must be transported in packaging or in a special grain carrier in order to avoid spillage and leakage of grain during transportation. Means of transport must comply with sanitary and anti-epidemic requirements.

Requirements prior to export

Before the export of soy, corn, rice and rapeseed to the PRC, the Chinese side sends phytosanitary specialists to Russia to carry out a preliminary check of the places of production, reviews and evaluates the effectiveness of the system for cultivating, transporting and exporting soy, corn, rice and rapeseed; the Russian side assists the Chinese side in conducting a preliminary check, guarantees the compliance of phytosanitary import requirements of soybean, corn, rice and rape imported into the PRC. If necessary, both parties can negotiate and jointly send technical specialists for on-site research. Before being exported, the Russian side quarantines the soy, corn, rice and rapeseed imported to the PRC. When meeting the protocol requirements, the Russian side issues phytosanitary certificate based on the relevant IPPC standards, and also indicates in the attached declaration: "This batch of corn / rice / soybean / rapeseed meets the phytosanitary requirements of the protocol (from 17 December 2015) imposed on corn / rice / soybean / rapeseed imported from Russia." The Russian side provides in advance to the Chinese side a sample of a phytosanitary certificate for its identification and accounting.

Imported soybeans must comply with the requirements of the “Law of the People's Republic of China on the quarantine of animals and plants imported and exported across the border” and its provisions on application, the Law of the People's Republic of China on food safety and its provisions on use, and the Law of the People's Republic of China on the inspection of import and export goods and its provisions on the application, the “PRC Regulations on the management of GMO safety in agriculture” and other regulatory legal acts, relevant standards and regulations.

According to I.3 of the Protocol on the requirements for corn, rice, soybeans, rapeseed, the Russian Party provides state control during the transportation of corn, rice, soybeans, rapeseed for export until shipment, taking all possible measures to reduce the likelihood of development of quarantine pests for the PRC and the exclusion of the presence of grain and other impurities.

In accordance with paragraph 4 of the Protocol on the requirements for corn, rice, soybeans, rapeseed, the Russian Party, in the process of storage, transportation of corn, rice, soybeans, rapeseed, before shipment for export, takes measures to clean the grain of these crops in order to remove soil, residues of plant parts , seeds of dangerous weeds and other impurities.

According to paragraph 3 of the Protocol on the requirements for meal, cake, products must be free from pests that are quarantined for the PRC, other living pests, excrement or animal remains, bird feathers, soil, as well as from genetically modified components not officially registered in compliance with national laws of the PRC.

According to the International Standard for Phytosanitary Measures No. 7 “Export Certification System” (Rome, 1997), export goods certified in accordance with the export certification system must meet the current phytosanitary requirements of the importing country.

In accordance with paragraph 4 of the International Standard for Phytosanitary Measures No. 12 “Guidelines for Phytosanitary Certificates” (Rome, 2011) phytosanitary certificates should only be issued if it is confirmed that the imported phytosanitary requirements are met.

By virtue of paragraph 7 of the Rules on quarantine supervision and control at the border when importing and exporting grain crops, approved by order of the Main State Administration of the People's Republic of China on 20.01.2016 No. 177 quality control, inspection and quarantine (posted on the website www.fsvps.ru), the addition of impurities to grain imported into the PRC is prohibited.

In this regard, phytosanitary certification of grain products, as well as cake and meal in China is possible only subject to the above requirements.

Thus, in the presence of extraneous impurities in batches of grain, meal and cake intended for export to China, the Rosselkhoznadzor Administration for the Primorsky Territory and the Sakhalin Region will refuse to issue a phytosanitary certificate due to non-compliance of the batch of regulated products with the phytosanitary requirements of the importing country according to 14 The procedure for issuing a phytosanitary certificate, a re-export phytosanitary certificate, a quarantine certificate, approved by order of the Ministry of Agriculture of Russia from 13.07.2016 No.293.

Quarantine review and approval

Before importing soybeans, maize, rice and rapeseed, the cargo owner or his representative must apply to the General Directorate for a “Quarantine permit for the import of plants and animals”. The import of soybeans, corn, rice and rapeseed is carried out from the established checkpoints that meet the relevant requirements; the production and processing of grain is carried out at enterprises that have passed the inspection and quarantine department satisfactorily. A check is being carried out for soybeans, corn, rice and rapeseed with the "Quarantine Permit for the Import of Plants and Animals" issued by the General Directorate. The cargo, declaring about GM products, is checked for the presence of the accompanying "Agricultural GMO Safety Certificate".

With regard to imported soybeans, corn, rice and rapeseed, it is necessary to carry out inspection and quarantine and pay special attention to pests of quarantine value specified in paragraph 4 of these Requirements, on the basis of the "Rules for control during inspection and quarantine of imported and exported grain crops and feed" ( Decree of the Main Directorate No. 7), "Working Guidelines for Inspection and Quarantine of Plants", the corresponding provisions of the "Working Regulations for Conducting Field Inspections and Quarantine of Imported Grain Crops Transported in Containers" (draft) (Main Directorate [2007], No. 7) and other relevant legal acts. After the importation of soybeans, corn, rice and rapeseed, they are used for processing, the direct admission of these crops to the market is prohibited, and the use for cultivation is prohibited. Inspection and quarantine departments must exercise quarantine supervision over the prevention of spillage and leakage of imported crops during transportation, as well as for compliance with the phytosanitary anti-epidemic requirements of the PRC of the transportation, loading and unloading processes. Inspection and quarantine departments must monitor weeds contained in soybeans, corn, rice and rapeseed imported from Russia, and other foreign epidemic situations in accordance with the Guidelines of the Main Directorate for Monitoring Pests. In cases of non-compliance with the requirements for the interception of pests of quarantine value, the following measures are applied: the consignment is subject to effective processing to eliminate the pests and then allowed for import. In the absence of effective treatment to eliminate pests cargo subject to return or destruction. Relevant costs are paid. EXPORTER.

Under serious circumstances, the import of grain from relevant Russian exporters, storage facilities and exporting regions is temporarily suspended until effective remedial measures are taken to improve the situation. If other pests of quarantine value not specified in the requirements are detected, it is necessary to take appropriate measures in accordance with the “Law of the People's Republic of China on the quarantine of animals and plants imported and exported across the border” and its provisions on use. Other inspection and quarantine requirements In accordance with the “PRC Food Safety Act” and its application provisions, the PRC’s Law on Inspection of Import and Export Goods and its application provisions, the PRC’s Regulation on the Management of GMO Safety in Agriculture and other relevant regulations safety and sanitation of imported grain, GMOs and other characteristics must comply with the standards of the PRC. In the event that incidents of non-compliance are identified according to the law, appropriate inspection and quarantine measures should be taken.
