Technical Regulations This is a document that establishes the characteristics of products (services) or related processes and production methods, design processes (including surveys), buildings, structures and facilities, construction, installation, commissioning, operation, storage, transportation, sale and disposal. It may also include requirements for terminology, symbols, packaging, labeling or labeling, or be entirely devoted to these issues.
Technical Regulations adopted (ECE) establishes mandatory for application and execution in the territory (EAEUa) requirements for objects of technical regulation.
In addition to the technical regulations of the CU and the EAEU, Russia has technical regulations adopted by the regulatory legal acts of the Russian Federation. Russian technical regulations are valid until the technical regulations of the Union come into force.
There is a single list of products for which mandatory requirements are established within the framework of the Customs Union and national legislation.
Until the day when the relevant technical regulations come into force, administrative responsibility in Russia is applied for failure to comply with the mandatory requirements established by the regulatory legal acts of the Commission of the Customs Union, as well as the requirements of national regulatory legal acts that do not contradict them.
According to the Federal Laws "On Technical Regulation" N 184-FZ. Chapter 2. Article 6. Technical regulations are accepted in order to:
protection of life or health of citizens, property of individuals or legal entities, state or municipal property;
environmental protection, life or health of animals and plants;
warning actions misleading buyers;
* Adoption of technical regulations for other purposes is not allowed.
According to the Federal Law "On Technical Regulation" N 184-FZ:
Technical regulations should contain a list and (or) description of the objects of technical regulation, requirements for these objects and rules for their identification in order to apply technical regulations. A technical regulation must contain rules and forms of conformity assessment (including technical regulations may contain conformity assessment schemes, procedures for extending the validity period of a issued certificate of conformity), determined taking into account the degree of risk, deadlines for conformity assessment for each technical regulation object and (or a) requirements for terminology, packaging, labeling or labels and the rules for their application. Technical regulations should contain energy efficiency requirements.
Mandatory requirements contained in technical regulations [...] have direct effect on the entire territory of the Russian Federation and can be changed only by amending and supplementing the relevant technical regulation.
Requirements not included in technical regulations [...] cannot be binding.
Technical regulations are applied in the same way and equally regardless of the country and (or) the place of origin of products.
A technical regulation adopted by federal law or a decree of the Government of the Russian Federation enters into force no earlier than six months from the date of its official publication.
